The Northeast Tennessee Association of Realtors (NETAR) has been at the forefront of this shift. Michelle Davis, the President of NETAR, sheds some light on what this new rule means for both realtors and homebuyers. “The biggest change is the mandatory buyer’s agreement,” Davis explains. “Essentially, it means that there’s going to be a lot more communication with buyers before showing them a home. They’re going to understand your fees and what those fees cover.”

So, what exactly is this buyer’s agreement? At its core, it’s a document that outlines the working relationship between a buyer and their real estate agent. This agreement spells out all the terms and conditions, including commissions, which Davis mentions are not set in stone. “We can negotiate those into the offer, and if it aligns with the sale of the home for the seller, then it’s accepted,” she says.

For some, like homebuyer Lori Wooten, this level of transparency is not new. Wooten has previously used buyer’s agreements and appreciates how clearly everything is laid out. “The terms of the contract were clear, and commissions were always negotiable, so I’ve never had any concerns,” Wooten shares.

Davis emphasizes that the ultimate goal is to ensure clients feel comfortable and well-informed throughout the entire process. “We want what’s best for our clients. A big part of our job is to ensure you make an educated decision, so we try to explain everything,” she notes.

Interestingly, Davis points out that many real estate agents in the region were already using some form of buyer’s agreement before it became mandatory. However, for those who are new to the concept, NETAR offers optional training classes to help both buyers and sellers understand these agreements better.

These changes come amidst a busy time for the real estate market. There are schedules to keep, houses to visit, and deals to close. But with these new rules, the idea is to make everything clearer and more streamlined.

Homebuyers can now go into the process with a better understanding of what to expect and what they are paying for. On the flip side, realtors are now bound to ensure that their clients are more informed than they’ve ever been before. “We offer these training programs to make sure our realtors are up to speed and comfortable with these new agreements. After all, it’s their job to make sure clients are making informed decisions,” Davis says. The benefits seem to far outweigh any initial discomfort, leading to better client-realtor relationships.
